Quarry Hearing to Take Place During Special Meeting in July
The Zoning Board of Appeals (ZBA) hearing regarding cease and desist orders for the quarry on Barberry Road was again postponed at the June 15 meeting, but the ZBA voted to hold a special meeting on Thursday, July 13 at 7 p.m. at the East Haven Senior Center for the hearing.
Attorney Peter Alter, who represents quarry owner John Patton, said that the hearings will require extensive discussion and testimony, which is why he and Town Attorney Joseph Zullo requested a special meeting for the appeals.
The special meeting will include a hearing for two cease and desist orders for the quarry. One is an amended cease and desist for the slashing of trees, and the other is for quarrying operations such as excavation/grading of topsoil, sand, and gravel.
The original cease and desist order for the slashing of trees will not be heard, as the amended cease and desist order supersedes and replaces it.
The quarry owner previously filed a $25 million lawsuit against Mayor Joseph Maturo, Jr. and three other town officials, alleging that town officials have acted illegally to put the legally operating quarry out of business. Town officials and quarry neighbors allege the quarry has been conducting operations without proper permits.
